Kai Buchan and Brooklyn Hutton entered the fast food restaurant at the Four Corners in the city centre at 1.20am on January 21, 2024.

Buchan started vaping inside. Security staff warned him to stop. He refused.

At 2.20am, a bouncer and a man went up to him and asked him to leave.

The 23-year-old stood up and approached the pair aggressively.

He was told to step back and leave the Argyle Street restaurant.

Instead, Buchan pushed and punched Ejaz Aslam in the face and body. He then assaulted KJ Khan by striking him in the head.

They both tried to defend themselves and Hutton, 24, tried to stop the assault.

The brawl was still going when police officers arrived and took hold of Buchan.

He was cautioned, charged and handcuffed.

Cops also tried to arrest Hutton. He was taken to the ground as he resisted the handcuffs and put his hand on his chest.

Security staff took hold of him and handcuffs were applied.

The duo, both from Dundee, appeared at Glasgow Sheriff Court this week after Buchan pleaded guilty to two assault charges and Hutton admitted to trying to punch a man and resisting arrest.

Sheriff Mark McGuire observed: “There is no injury libelled to the complainers.”

The pair’s lawyer said about Buchan: “He is 23 years old. I have seen the CCTV and he was correct when he said he was pushed first.

“Of course, this all started when he was told to stop vaping. There was a stand-off, he was pushed first and what he did after is assault. That is what happened.”

Regarding Hutton, the solicitor added: “His position is different.

“He tried to intervene in this as a peacemaker. The police who entered, it would seem they misinterpreted his actions.

“He had a dislocated shoulder and was released from hospital shortly before this offence.

“The worst thing they could have done was handcuff him behind his back.”

Sheriff McGuire remarked: “The police tried to engage with him and it appears he was in pain.”

The lawyer agreed and explained that Hutton left his job as a result of having to attend court.

Buchan was sentenced to 135 hours of unpaid work, to be completed within 12 months.

He will also be supervised by a social worker for one year.

Hutton was fined £135 plus a £10 victim surcharge.
